CBD Oil in Wisconsin: Is it Legal, Where to Buy, and More

The residents of Wisconsin have remained confused over whether or not CBD oil is legal in the state or not. Cannabidiol (CBD) is used all across the United States, though it isn’t legal everywhere. The majority of its users take it to relieve them of a growing list of health concerns that the new “it” drug helps to treat.

With so much confusion rising over whether or not CBD oil is legal in Wisconsin, Brad Schimel, the state’s District Attorney, clarified where things stand.

Is CBD Oil Currently Legal in Wisconsin?

CBD (Cannabidiol) is one of the active cannabinoid chemicals that are found in marijuana plants. Another main cannabinoid chemical is the primary psychoactive called THC (tetrahydrocannabinol.) Unlike THC, the cannabidiol compound doesn’t produce hallucinogenic effects or create the “high” that marijuana, and its variants, are known for.

During District Attorney Brad Schimel’s clarification, he made it clear that CBD oil resulting from industrial hemp are legal in Wisconsin. Limited circumstances and the supervision of a doctor are required. Hemp CBD oil contains less than 0.03% THC, while cannabis CBD oil derived from the marijuana plant is illegal. It includes enough THC to induce the “high” that some people seek.

There is a specialized industrial hemp program put into place in Wisconsin. It allows farmers to not only grow industrial hemp, but sell it. However, they do require a permit from the Department of Agriculture. So long as farmers are following the rules and regulations, they cannot be criminally prosecuted for growing or selling industrial hemp, or its derivatives.

The farmers who are participating in Wisconsin’s pilot program are fully protected, as are the dispensaries and retail outlets that the farmers are selling the industrial hemp and CBD oil to. The oil needs to be appropriately labeled, ensuring that the consumer is aware of what they are purchasing to confirm their safety.

Distributors and Law Enforcement

Memos to law enforcement in Wisconsin have been sent to clear up any issues on how they are to navigate any potential problems. With the clarity that officials now have, police have a clear understanding of how to keep residents of Wisconsin using CBD oil safe. The previous state law left officials with no adequate knowledge, and they needed to fix the issue on their own.

Distributors of industrial hemp processed into CBD oil or any other variation are to advise all dispensaries, outlets, and retail stores purchasing their product that they have followed all regulations. The labeling needs to state that the product comes from industrial hemp and has less than 0.03% THC.

When law officials in any Wisconsin county come across CBD products in stores, their duty is to determine that the product is being sold legally. Otherwise, police are to remove it from the shelves and request to search the space for other illegal CBD products. Surprisingly, research has shown that despite labeling, the majority of CBD oil that has been tested contained THC. Once the product includes tetrahydrocannabinol above 0.03%, it’s illegal.

Medical Marijuana Program

Wisconsin is one of the most repressive states in the United States concerning medical marijuana programs and policies that have been implemented. The CBD-only bill was signed in 2014 that said patients with Epilepsy or other seizure disorders could receive legal protection when found with CBD. In 2017, Lydia’s Law was introduced. Lydia’s Law states that all patients with any medical condition that has a letter from their doctor are protected.

Lydia’s Law still references CBD-only products, and regardless of if there is a doctor’s note, it is still illegal to possess CBD or cannabis with traces of THC. The law is unfortunately named Lydia’s Law as a tribute to young Lydia Schaeffer who suffered from a rare form of Epilepsy and died in her sleep. It was consistent lobbying by Lydia’s mother, family, activists, and other families that helped get it pushed to Governor Scott Walker’s desk. A month after the governor signed the bill, Lydia passed away in her sleep on Mother’s Day.

Despite hemp CBD oil being legal in Wisconsin, it remains relatively tricky for deserving patients to get their hands on a letter from their doctor. Physicians require drug permits from the federal FDA.
